Meta陷1.4兆美元社群媒体诉讼无论胜败都难逃风险

《Yahoo Finance》报导，Meta(META-US)正与美国4个州的检察长对簿公堂。诉讼指控这家社群媒体公司蓄意设计旗下应用程式，以吸引儿童和年轻使用者沉迷其中，并对平台可能造成的伤害作出虚假陈述。

Meta否认相关指控，表示公司透过多项功能和选项，致力于保护平台上的年轻使用者。

如果Meta在这场由美国加州北区联邦地方法院奥克兰分院Yvonne Gonzalez Rogers法官审理的诉讼中败诉，这些州可能迫使Meta大幅重新思考其应用程式的设计，包括移除无限滚动和限时消失贴文等主要功能。

但即使Meta胜诉，公司仍可能为了避免后续数千起诉讼而修改服务。

杜兰大学Freeman商学院教授Rob Lalka表示，「这是Meta长期以来一直不愿面对的时刻，无论结果如何，这都将改变这家公司的发展方向。」

Meta对决各州政府

这起诉讼是涉及另外25个州的更广泛诉讼中的测试案件。加州、科罗拉多州、肯塔基州和新泽西州的检察长指控Meta违反消费者保护法，透过误导使用者使其相信旗下应用程式是安全的，同时指控Meta违反《儿童线上隐私保护法》(COPPA)，未经家长许可便搜集13岁以下儿童在其服务上的资料。

加州这起诉讼只是Meta因其对青少年及年轻使用者造成影响而面临的一连串诉讼中最新一起。Meta此前已在洛杉矶和新墨西哥州输掉两起案件，公司表示将提出上诉。

这些案件各有不同，但整体而言都聚焦Meta如何设计旗下产品，而非平台上所承载内容。这项区别十分重要，因《通讯规范法》(Communications Decency Act)第230条使Meta及其他网路平台免于为使用者发布的内容承担责任。

宾州州立大学Dickinson法学院教授Daryl Lim表示，「对我来说，这起案件更大的意义在于，法院是否会开始接受这样的观点：社群媒体产品的设计选择，是企业可以被追究责任的事项，而不只是将争议主要视为使用者发布有害内容的问题。」

Lim指出，「如果这种法律主张持续获得支持，不仅会改变Meta面临的诉讼风险，也会对整个社群媒体产业产生更广泛的影响。」

Meta表示，各州检察长提出的诉讼是一场价值1.4兆美元的「捞钱行动」，这是公司所称检察长们在Meta败诉情况下要求公司支付的金额。

Meta发言人在周二的开庭陈词前表示，「州检察长们可能称这是一起具里程碑意义的案件，但他们提出的有限指控缺乏证据支持，其财务要求也远远不成比例。」

该发言人指出，「州检察长们没有证据证明其所在州有任何人受到误导，声称像是拥有额外Instagram帐号这类无害功能竟然伤害了当地居民，并试图因年龄验证等整个产业共同面临的挑战而惩罚Meta。他们没有依据事实或法律，而是选择追逐一笔荒谬的赔偿金。我们坚持自身在为青少年提供强力保护方面的纪录，也期待在法庭上提出我们的主张。」

然而，Lalka认为，这些改变仍不够。

他表示，「Meta当然会试图证明，公司已经采取措施保护儿童。但这些州检察长要求的改变，正是Meta过去没有主动采取的措施。」

如果法官裁定Meta败诉，迫使公司修改产品设计，雪城大学传播学教授Alexis Shore Ingber表示，Meta仍可以继续蓬勃发展。「我们能否在不损害Meta商业模式的情况下，打造有效的产品设计？答案是可以。」

她补充，「整体而言，Meta仍有许多方式可以获利，同时承诺不透过欺骗消费者，使他们陷入不安全的使用行为。我认为，Meta需要投入资源研究如何在赚钱的同时保护消费者。」

auto;display:block;\">\n\n\nMeta否认相关指控，表示公司透过多项功能和选项，致力于保护平台上的年轻使用者。\n\n如果Meta在这场由美国加州北区联邦地方法院奥克兰分院Yvonne Gonzalez Rogers法官审理的诉讼中败诉，这些州可能迫使Meta大幅重新思考其应用程式的设计，包括移除无限滚动和限时消失贴文等主要功能。\n\n但即使Meta胜诉，公司仍可能为了避免后续数千起诉讼而修改服务。\n\n杜兰大学Freeman商学院教授Rob Lalka表示，「这是Meta长期以来一直不愿面对的时刻，无论结果如何，这都将改变这家公司的发展方向。」\n\nMeta对决各州政府\n\n这起诉讼是涉及另外25个州的更广泛诉讼中的测试案件。加州、科罗拉多州、肯塔基州和新泽西州的检察长指控Meta违反消费者保护法，透过误导使用者使其相信旗下应用程式是安全的，同时指控Meta违反《儿童线上隐私保护法》(COPPA)，未经家长许可便搜集13岁以下儿童在其服务上的资料。\n\n加州这起诉讼只是Meta因其对青少年及年轻使用者造成影响而面临的一连串诉讼中最新一起。Meta此前已在洛杉矶和新墨西哥州输掉两起案件，公司表示将提出上诉。\n\n这些案件各有不同，但整体而言都聚焦Meta如何设计旗下产品，而非平台上所承载内容。这项区别十分重要，因《通讯规范法》(Communications Decency Act)第230条使Meta及其他网路平台免于为使用者发布的内容承担责任。\n\n宾州州立大学Dickinson法学院教授Daryl Lim表示，「对我来说，这起案件更大的意义在于，法院是否会开始接受这样的观点：社群媒体产品的设计选择，是企业可以被追究责任的事项，而不只是将争议主要视为使用者发布有害内容的问题。」\n\nLim指出，「如果这种法律主张持续获得支持，不仅会改变Meta面临的诉讼风险，也会对整个社群媒体产业产生更广泛的影响。」\n\nMeta表示，各州检察长提出的诉讼是一场价值1.4兆美元的「捞钱行动」，这是公司所称检察长们在Meta败诉情况下要求公司支付的金额。\n\nMeta发言人在周二的开庭陈词前表示，「州检察长们可能称这是一起具里程碑意义的案件，但他们提出的有限指控缺乏证据支持，其财务要求也远远不成比例。」\n\n该发言人指出，「州检察长们没有证据证明其所在州有任何人受到误导，声称像是拥有额外Instagram帐号这类无害功能竟然伤害了当地居民，并试图因年龄验证等整个产业共同面临的挑战而惩罚Meta。他们没有依据事实或法律，而是选择追逐一笔荒谬的赔偿金。我们坚持自身在为青少年提供强力保护方面的纪录，也期待在法庭上提出我们的主张。」\n\n然而，Lalka认为，这些改变仍不够。\n\n他表示，「Meta当然会试图证明，公司已经采取措施保护儿童。但这些州检察长要求的改变，正是Meta过去没有主动采取的措施。」\n\n如果法官裁定Meta败诉，迫使公司修改产品设计，雪城大学传播学教授Alexis Shore Ingber表示，Meta仍可以继续蓬勃发展。「我们能否在不损害Meta商业模式的情况下，打造有效的产品设计？答案是可以。」\n\n她补充，「整体而言，Meta仍有许多方式可以获利，同时承诺不透过欺骗消费者，使他们陷入不安全的使用行为。我认为，Meta需要投入资源研究如何在赚钱的同时保护消费者。」\n<div class=\"related-articles
